Why was the scepter part of the birthright inheritance given to Judah instead of Joseph?

ESV - 1 The sons of Reuben the firstborn of Israel ( for he was the firstborn, but because he defiled his father's couch, his birthright was given to the sons of Joseph the son of Israel, so that he could not be enrolled as the oldest son. 2 Though Judah became strong among his brothers and a chief came from him, yet the birthright belonged to Joseph).

I humbly submit that in Genesis 49 Jacob gathers and then prophesied over the twelve tribes of the young nation in very enigmatic riddles.

Genesis 49:8 Concerning the prophecy spoken by Jacob over the tribe of Judah

Genesis 49:10 the scepter of imperial authority, sovereignty will not depart Judah until "Shiloh" recognized by rabbinical authorities as the Messiah.
